The appeal ruling on ineligibility
The five-year ban from public office was applied with immediate effect in March 2025, which is the single mechanical reason the price sits at the floor. A ruling that removes or suspends the ineligibility is the only development that would push this probability up by more than a rounding error. A ruling that confirms it effectively ends the question before the campaign begins.
Bardella's entrenchment as RN candidate
Jordan Bardella has been the party's presumptive candidate since the conviction, with his own contract in the same market complex. Every month of that arrangement raises the cost of a switch back to Le Pen even if she is cleared. This driver pushes the Le Pen probability down and the RN-successor probability up, independently of the courts.
Candidacy filing deadlines
Candidates must be sponsored and validated by the Conseil constitutionnel in the weeks preceding the April 2027 first round. A favourable ruling that arrives after that window closes has no effect on the outcome. Timing, not just substance, determines whether a legal reversal matters.
The two-round structure
Even a Le Pen candidacy has to clear a runoff, and she lost the 2017 and 2022 second rounds. This is a secondary constraint given the eligibility problem, but it means the market would not jump to a high number on legal clearance alone — it would move to something well short of even.
Venue agreement
A dozen order books, each with several million dollars of volume, all reading at the floor. That consistency is itself information: it signals no meaningful minority of participants sees a live path, and it means the price is unlikely to drift without a discrete news event.
The case for
- The appeal court would have to overturn the conviction, or leave the conviction standing while lifting or suspending the five-year ineligibility, with a ruling final enough to satisfy the Conseil constitutionnel before candidacies are validated in spring 2027.
- The Rassemblement National would then have to withdraw Jordan Bardella and restore Le Pen as its candidate, a reversal of two years of succession planning.
- She would need to reach the runoff, which she has done in both 2017 and 2022, and then win a second round for the first time — requiring transfers from voters who have so far declined to back her.
- A collapse or fragmentation of the centre and left field, with no consolidating candidate emerging in Macron's place, would be the environment in which such a second round becomes winnable.
The case against
- The ineligibility from the March 2025 conviction was imposed with immediate effect, so absent a decisive reversal she cannot legally file a candidacy for April 2027.
- The RN already has a functioning alternative in Bardella, which means even a favourable ruling does not automatically return the nomination to her.
- She has contested two presidential runoffs and lost both, the second by a clear margin, so the electoral case was never settled even before the legal problem.
- Every listed venue prices this at the floor across more than $116 million of volume in the candidate complex, indicating no significant body of participants sees a path that the headline facts do not already reflect.
